I am a yearly tenant and my rent expired in April 2020. My landlord is requesting we pay the rent immediately.

We asked for time to pay but he insists we must pay part or leave the house in 3days..

He has threatened to make us uncomfortable until we leave.

What steps can we take to avoid harassment from him? Is he bound to issue quit notice and give us time to get another place considering the rent has expired? How much time is expected to give us to move out?

Thank you for contacting us.

Please note that your landlord cannot evict you unless he has followed the proper process for eviction, and therefore if you do not ‘leave the house in 3 days’, he cannot forcibly remove you if the eviction process has not been completed.

To avoid harassment you can consider sending him a cease and desist letter to stop the harassment. You get one for free by chatting with our Tenancy chatbot here – LATIFA

The length of notice required will depend on where your property is located. If your property is located in an area where the Lagos Tenancy Law 2011 is in operation, your landlord does not need to issue you a quit notice, as you had a fixed tenancy. Please read more about the process here –
