Patent Registration – Frequently asked Questions

 

Who provides the service?

The service is provided by independent qualified lawyers, and all payments go to the lawyer. LawPàdí does not engage in any fee splitting arrangement or do any work on a paid referral basis, as this is against the Rules of Professional Conduct 2007 for Nigerian Lawyers. LawPàdí does not provide any legal services here, all we do is match the lawyer with the client.

The service is in 2 stages.

 

Stage 1 – Initial Consultation

 

Q: HOW DOES THE CONSULTATION WORK?

A: Consultations are either done in person, by email or over the phone. The consultation is done with a qualified lawyer, and all payments go to the lawyer. LawPàdí does not engage in any fee splitting arrangement or do we work on a paid referral basis, as this is against the Rules of Professional Conduct 2007 for Nigerian Lawyers. LawPàdí does not  provide any legal services here, all we do is work with both the client and lawyer to schedule a convenient time for the consultation.

 

Q: HOW MUCH DOES THE CONSULTATION COST?

A: The consultation fee is based on the type of consultation package chosen, and ranges from N15,000 to N30,000. Please note that there is no free consultation for the Patent consultation as all conversations need to be done under a confidentiality agreement, and this requires payment of a consultation fee. This is done in order to protect the intellectual property of the inventor.

 

Q: CAN I OBTAIN A REFUND?

A:We strive to ensure that the lawyers we refer you to are lawyers with the requisite knowledge to handle your queries and questions. However, if for any justifiable reason you unhappy with the quality of the information provided to you by the lawyer, we will work to try to get a refund of the consultation fee for you. Please email [email protected] with full details of the reason for the refund request and we will respond within 7 working days. Please note that refunds are only applicable where the consultation never took place as scheduled, or the information provided is totally and wholly incorrect (we will not refund because the information provided to you by the lawyer is not the outcome you hoped for).

 

Q: HOW LONG WILL IT TAKE TO SCHEDULE A CONSULTATION?

A: We endeavour to set up a consultation for the paid consultations within 24 hours of booking. However, this is flexible based on the availability of the client and the lawyer. Free consultations take anywhere from 7-10 business days.

 

Q – WHAT WILL THE OUTCOME OF THE CONSULTATION BE?

A: At the end of the consultation the lawyer will provide you with a brief confidential consultation report detailing the strengths and weaknesses of your potential application, and will advise whether your invention meets the criteria for patentability and whether or not you should proceed with the application and move to stage 2 below.

 

Stage 2 – Patent Application

 

Q – WHAT DOES THE SERVICE COVER? 

The service covers the entire process from drafting the patent application, filing the application with the Patent Registry, and obtaining the Certificate.

 

Q – HOW DOES THE PROCESS WORK?

  • Step 1 – The Lawyer will send 2 documents – a Power of Attorney and an Invention Disclosure Form. The Power of Attorney is necessary because they will need your authority to file the application with the Patent Registry. The Invention Disclosure Form will give more detail about your invention.
  • Step 2 – Once they receive the documents, they will get to work drafting the documentation. Once complete, they will provide the drafts to you for your feedback and then when you are in agreement with the content of the application, they will proceed to file the application.

 

Q – HOW LONG DOES THE PROCESS TAKE? 

  • Patent Drafting: 1-2 weeks
  • Acknowledgment letter – 24 hours from submission
  • Acceptance Letter: 6-8 weeks from submission
  • Grant of Certificate: 6 weeks from Acceptance

Q- HOW MUCH DOES THE PATENT APPLICATION COST?

This will depend on what the invention is and the complexity of the application, however as a guide, this is generally what you should expect to pay for the following type of patent applications:

  • Process Patent – N150,000
  • Game Show Patent – N150,000
  • Manufacturing Patent – N350,000
  • IT Patent – N500,000
  • Pharmaceutical Patent – N500,000
  • Oil and Gas Industry Patent – N1,000,000

Q- HOW CAN I MAKE PAYMENT?

Payment is made directly to the lawyer and is made in 2 tranches –  an initial 70% of the fee for the drafting of the patent documents and then a final payment of 30% upon receipt of the Acceptance Letter. 

 

Q – CAN I OBTAIN A REFUND?

We strive to ensure that the lawyers we refer you to are lawyers with the requisite knowledge to handle your queries and questions. However, if for any justifiable reason you unhappy with the quality of the work done by the lawyer, we will work to try to get a refund. Please email [email protected] with full details of the reason for the refund request and we will respond within 3 working days. Please note that refunds are only applicable where the lawyer failed completely to carry out the service
