I just got a mail from my MD,  that my salary has been  reviewed down ward by 60%. On pay day

Reason being that my superiors said I don’t carry out my duties

There has never been any prior warning or query

Do I have a case?

By unilaterally reviewing your salary downwards by 60%, it would appear your employer is in breach of one of the fundamental principles of natural justice: to give you a fair hearing. The proper process would have been to issue you with a query containing the allegations, and to give you an opportunity to respond to the query. By not doing this, the employer has breached your rights.

Further it would appear that this is also a breach of your contract of employment, as your employer has unilaterally altered the terms of the contract (unless the employment contract gives the employer this power).

Therefore, we believe that your employer has not acted in good faith, and you therefore have rights which can be enforced.
