A lawyer wrote a power of attorney for me since 1995, with which l leased out my Palm plantation(land) for 15 years, and the same lawyer is now appearing in court against me that the Palm plantation (land) does not belong to me, but belongs to my brothers who happen to be my witness in the said power of attorney.

My question is; “does this act constitute a misconduct in the Nigeria Bar Association. Thanks

Hello

Thank you for your question.

There is a clear conflict of interest issue here, and the lawyer should definitely not be representing your brothers in a case against you. We suggest that you ask your current lawyer to bring this information to the court’s attention and in fact, the lawyer could be called as a witness to prove the ownership of the land in your favour.

We suggest you speak to your current lawyer, and as him to bring these facts to the attention of the courts.
