If you were to sue it would be unlikely that you would be successful, as you would have to proof that you have suffered some quantifiable damages by reason of the delay in not getting the data at the time you requested it. Further, if the network provider was able to show that there were technical unforeseen challenges which led to the delay and there was no negligence or malice involved, then it would make your claim even less likely to succeed. However, please note that is if you decided to sue in a court of law.
