I have a friend that works as a contract staff (Cook) for an organisation. He has been working with them for over 1 year and 6 months and is yet to go on leave. I’ll like to know if he is entitled to leave as a contract staff and what exactly the law says on contract or casual staff.
Thank you for your question. We are not aware of any specific law that deals with contract or casual staff in Nigeria. Therefore in determining the rights of these workers, you will have to consider the general laws as it relates to unfair work practices. As an employee you are entitled to time off work/leave, however as a contract staff you are not necessarily entitled to paid leave. Generally most contract/casual staff do not get paid leave. However please note that the situation will largely depend on the terms of the contract of the individual.
